If there is an inspection after the accident, it may be difficult for a contractor to prove that no one was ever exposed to asbestos. It will be difficult to prove that a contractor was not responsible for workers' exposure to asbestos in the past. The owner of the site may not be liable if he or she did not know about the Asbestos in the soil or did not warn the workers about asbestos.
